Terms of sale
The General Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, persons making a purchase via the NCMG SAS website www.ker-sun.com, hereinafter referred to as"the Customer"and on the other hand the company NCMG SAS, hereinafter referred to as"Ker-Sun"These conditions apply exclusively to non-commercial individuals.
I/Price of items and Order
Price
All prices are indicated all taxes included, excluding shipping costs (see paragraph Shipping and Returns)
The prices of the items offered on Ker-Sun are valid for 24 hours from their publication on the site www.ker-sun.com. The items will be invoiced on the basis of the rates in effect at the time of order entry.They remain the property of Ker-Sun until full collection of the price by Ker-Sun.
Ordered
The Customer can place an order on the website www.ker-sun.com
The ordering process is as follows:
- Choice of items and addition to cart
- Validation of the contents of the basket
- Identification on the site www.ker-sun.com if the Customer is not already identified or filling in the fields to give his contact details
- Choice of delivery method
- Choice of payment method
- Payment validation
The Customer will be able to view during these different stages the details of his order and its total price and correct any errors, before confirming it to express his acceptance.The Customer will receive an order confirmation emailKer-Sun reserves the ownership of the items until full payment of the order, that is to say upon receipt of the price of the order by Ker-Sun Ker-Sun reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or who would present in his eyes any form of risk.
Any order implies acceptance of the prices and description of the items available for sale.Ker-Sun undertakes to honor orders received on the website only within the limits of available stocks.In the absence of availability of one or more item (s) ordered, Ker-Sun undertakes to inform the Customer as soon as possible, and if necessary to reimburse it at the latest within 14 days following the date on which he exercised his right of withdrawalThe Customer's order will then be automatically canceled.
Ker-Sun reserves the right to verify the personal data communicated by the Customer and to adopt all measures deemed necessary to verify that the person who placed the order is indeed the holder of the Customer account and/or the means payment methods used, in order to avoid any identity theft or fraudulent payment.
II/Shipping and returns
Ker Sun offers a free delivery option for orders of €40 or more. All orders are dispatched within 24 working hours, Monday to Friday, from France.

Metropolitan France and Monaco
The 24 working hours of order preparation time are taken into account in the time estimates below:
- Delivery to Pick-up Points (Mondial Relay) - 3 to 6 working days: Free for orders over €40 (otherwise €3.90)
- Standard Home Delivery (UPS) - 2 to 3 working days: €3.90
- Express Home Delivery (Chronopost): €9.90
- Next working day delivery for orders placed before 12 pm
- Delivery within 2 working days for orders placed after 12 pm

Returns
You have 15 days from the date of receipt of your order to request a return for any unused and unworn item. Ker Sun provides a return label free of charge and fully refunds returned items.
If you would like to make an exchange, Ker Sun invites you to return the item and place a new order.
Condition of the package on delivery:
The Customer is required to check the condition of the items delivered. Any anomaly concerning the items (damage, item missing from the order form, damaged or open package, broken item, etc.) must be indicated within 3 days of delivery.

Fight against bank card fraud
Ker-Sun reserves the right to verify the personal data communicated by the Customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to avoid any fraudulent paymentThis verification may take the form of a request for proof of identity and/or address.The Customer's failure to respond to a request of this type within 2 days of the request made by Ker-Sun will automatically result in the cancellation of the order concerned, without any possibility of subsequent complaint.
Ker-Sun will also be free to directly cancel an order that presents one or more risk factors for fraudulent use of a bank card.

V/Guarantee
All items offered by Ker-Sun are subject to the legal guarantee provided for by articles L 217-4, et seq. Of the Consumer Code and the guarantee against hidden defects provided for in articles 1641 et seq. Of the Civil Code.
The Customer has two (2) years to assert one or other of these guaranteesFor the lack of conformity, the period starts from the issueFor hidden defects, the period starts from the discovery of the defect.
If the apparent defect, the lack of conformity or even the hidden defect of the article, declared by the Customer, if applicable, is proven, after expertise made, Ker-Sun may proceed to repair or replace the Product.If this is not possible, Ker-Sun reserves the right to reimburse the Customer at its expense.
However, Ker-Sun cannot be held responsible for the misuse and/or intensive use of the items that the Customer may make of them.Likewise, Ker-Sun cannot be held responsible for the return of a competing product and/or not sold on the Site by the Customer.It is the Customer's responsibility to return the correct item.
Ker-Sun does not offer any commercial guarantee.
VI/Responsibility
Ker-Sun is fully responsible towards the Client for the proper performance of the contract concluded with the Client.However, Ker-Sun cannot be held liable for the non-performance or improper performance of the contract concluded in the event of force majeure, the occurrence of an event attributable to the Customer or any inconvenience, unforeseeable and insurmountable damage inherent in the event. VII/Retention of title
Ker-Sun remains the owner of the goods until full payment of the price by the Customer.
VIII/Intellectual property
All texts, comments, works, illustrations and images reproduced on Ker-Sun are reserved under copyright as well as intellectual property and for the whole worldAs such and in accordance with the provisions of the intellectual property code, only use for private use is authorized, subject to different or even more restrictive provisions of the intellectual property code.Any total or partial reproduction of the Ker-Sun site is strictly prohibited without prior agreement.
IX/Mediation
According to articles L 611-1 et seq. Of the Consumer Code, the Customer has the right to have recourse free of charge (except for possible legal and expert fees) to a consumer mediator with a view to the amicable resolution of a litigation opposing it to NCMG SASSince February 15, 2016, the European Commission's amicable dispute resolution online platform has been open to the publicAny consumer who encounters a dispute with a company located in the territory of the European Union has the possibility to file a request for mediation through this European platform.You can also consult the website of the European Commission dedicated to consumer mediation.
X/Applicable law
These general conditions of use and sale are subject to French lawIn the event of a persistent disagreement on the application, interpretation and execution of these terms and conditions, and in the absence of an amicable agreement, any dispute will fall under the jurisdiction of the competent French courts.
